EvLo Lash Co. – Terms of Service

1. Introduction

This website is operated by EvLo Lash Co. (“EvLo Lash Co,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your use of our website (“Site”), our online store, and your purchase or use of any products or services from us (collectively, the “Service”).

By visiting our Site and/or purchasing something from us, you agree to be bound by:

We reserve the right to update or modify these Terms at any time by posting changes to this page. Your continued use of the Site after changes are posted constitutes your acceptance of those changes.

Our store is hosted on Shopify Inc., which provides the e-commerce platform that allows us to sell our products and services to you.

2. Eligibility & Professional Use

2.1 Age Requirement

By using this Site, you represent that you are at least the age of majority in your state or province of residence, or that you are the age of majority and have given consent for any minor dependents to use this Site.

2.2 Professional Use Only (for Certain Products)

Many of our products, including but not limited to UV curing lights, adhesives, and professional lash tools, are designed for professional use only.

By purchasing and using professional-grade products, you represent and warrant that:

  • You are a lash professional, licensed cosmetologist/esthetician, or trainee under supervision; or

  • You have received appropriate training to safely and correctly use professional lash products.

EvLo Lash Co is not responsible for injury, reactions, or damages caused by:

  • Misuse or improper application;

  • Use by untrained persons;

  • Failure to follow instructions, safety guidelines, or industry standards.

Your use of professional products is at your own risk.

3. General Conditions

We reserve the right to refuse service to anyone, at any time, for any reason, consistent with applicable law.

You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without our express written permission.

You understand that (excluding credit card information) your content may be transferred unencrypted and may involve transmissions over various networks. Credit card data is always encrypted during transfer over networks.

4. Product Information & Accuracy

We endeavor to display accurate product descriptions, images, and colors, but we do not warrant that product details or other content on the Site are error-free, complete, or current.

Any reliance on the material on this Site is at your own risk. We may modify product offerings or pricing at any time without notice.

5. Ordering, Billing & Account Information

We reserve the right to refuse, limit, or cancel any order placed with us.

We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order (including orders using the same account, credit card, or billing/shipping address). If we modify or cancel an order, we may attempt to notify you using the email and/or billing address/phone number provided at checkout.

You agree to provide current, complete, and accurate purchase and account information and promptly update such information as needed so that we can complete your transactions and contact you.

6. Shipping & Delivery

6.1 Shipping Policy Incorporated

Shipping of all orders is governed by our Shipping Policy, which is incorporated into these Terms by reference. By placing an order, you agree to that Shipping Policy.

6.2 Processing Time vs. Transit Time

Processing time (picking, packing, labeling, and carrier pickup) is separate from transit time. Once your order leaves our facility and is scanned by the carrier, shipping time begins.

6.3 Delivery Estimates

Any shipping estimates provided at checkout or elsewhere are not guaranteed delivery dates. We are not liable for delays caused by carriers, customs, weather, or other factors beyond our control.

6.4 International Shipping, Customs & Duties

For international orders, you are responsible for any customs duties, taxes, or import fees. Refusal or failure to pay customs fees may result in return or destruction of the package; we are not responsible for such outcomes.

6.5 Address Accuracy

You are solely responsible for entering a complete and correct shipping address. If a package is returned to us due to an incorrect, incomplete, or undeliverable address, you will be responsible for the cost of reshipment, in accordance with our Shipping Policy.

6.6 Risk of Loss

Once an order is handed to and scanned by the carrier, risk of loss passes to you. We are not responsible for lost, stolen, or misdelivered packages. Any claims must be filed directly with the carrier.

7. Order Finality, Cancellations & Discount Codes

7.1 No Cancellations or Modifications

Because we begin processing orders promptly:

  • Orders cannot be cancelled or modified once placed, including changes to products, quantities, shipping methods, or addresses.

  • We are unable to add discount codes, remove items, or combine orders after payment is complete.

7.2 Discount Codes

Discount codes must be entered correctly at checkout. If you fail to apply a code or enter it incorrectly, we are not able to adjust the order total or refund the difference after payment.

8. Returns, Refunds & Exchanges

All returns and refunds are governed by this Section as well as our published Shipping Policy. By purchasing from EvLo Lash Co., you agree that all returns must follow the guidelines below.

8.1 UV Lights & UV Light Kits – 30-Day Satisfaction Guarantee

We stand behind our professional UV curing systems. If you do not love your UV Light or UV Light Kit, you may return it under the following terms:

  • You must contact us within 30 days of receiving your light or kit.

  • You are responsible for covering the return shipping cost.

  • A refund for the light or full kit will be issued after we receive and inspect the returned item(s).

Unopened Items in Kits

If you purchased a kit, you may also return unopened items such as:

  • Adhesives

  • Tapes

  • Accessories

  • Any sealed products included in the kit

Refunds for unopened kit items will be processed once they are received and verified.

8.2 All Other Products – Non-Returnable Once Opened

Due to the nature of use and hygiene standards associated with lash products:

All products (except UV lights and kits covered above) are non-returnable and non-refundable once opened, unless there is a confirmed manufacturer defect.

To qualify for a defect review:

You must submit a return claim within 15 days of your purchase and follow these steps:

  1. Provide clear video and photographs along with a detailed written description of the defect. After review, we will determine whether the product is eligible for return.

  2. Email all documentation to: info@evlolash.com

  3. After evaluation, we will contact you with our determination and next steps.

  4. If we authorize a return, you must include a signed letter stating the reason for your return along with the original receipt.

  5. All returns must be shipped in their original packaging.

Products not meeting the criteria above will not be eligible for return or refund.

8.3 Restocking Fee

All authorized returns are subject to:

  • A 10% restocking fee, and

  • A return shipping fee (paid by the customer)

These amounts will be deducted from your refund.

We do not refund original shipping or handling fees paid on the order.

8.4 Condition of Returned Items

Returned items must:

  • Be in original condition,

  • Include all components and packaging, and

  • Pass inspection to confirm they have not been altered, used improperly, or damaged due to misuse.

Items not returned in acceptable condition may result in denial of refund at our discretion.

8.5 Final Sale Items

Certain items may be marked Final Sale or otherwise non-returnable. These items are not eligible for return or refund under any circumstances unless required by law.

8.6 Return Authorization Required

Do not return any product without contacting us first. Unauthorized returns may be refused and/or will not qualify for refunds.

8.7 Refund Method

Approved refunds will be issued to the original payment method unless otherwise stated. Store credit may be issued in cases where a refund to the original method is not possible.

9. Intellectual Property

All content on the Site— including text, graphics, logos, images, product descriptions, videos, digital courses, and training materials—is the intellectual property of EvLo Lash Co. or its licensors and may not be reproduced, distributed, or used without prior written consent.

10. Third-Party Tools & Links

We may provide access to third-party tools and links to third-party websites. We do not monitor or control such tools or sites and are not liable for any issues arising from their use. Your use of third-party tools or links is at your own risk and subject to the terms of those third parties.

11. User Comments, Feedback & Submissions

Any comments, feedback, ideas, suggestions, or other submissions you provide (collectively, “Comments”) may be used by us without restriction or compensation. We may edit, copy, publish, distribute, and otherwise use such Comments in any medium.

We are not obligated to maintain Comments in confidence, to pay compensation, or to respond.

You agree that your Comments will not violate any right of any third party, including intellectual property, privacy, or other personal rights, and will not contain unlawful, abusive, or obscene material.

12. Personal Information

Your submission of personal information through the Site is governed by our Privacy Policy.

13. Errors, Inaccuracies & Omissions

Occasionally there may be information on our Site or in the Service that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, and availability.

We reserve the right to correct any errors and to change or update information or cancel orders if any information is inaccurate at any time (including after you have submitted your order), as permitted by law.

14. Prohibited Uses

You are prohibited from using the Site or its content:

  • For any unlawful purpose;

  • To solicit others to perform unlawful acts;

  • To violate any laws or regulations;

  • To infringe upon intellectual property rights;

  • To harass, abuse, insult, harm, defame, or discriminate;

  • To submit false or misleading information;

  • To upload or transmit viruses or malicious code;

  • To collect personal information of others without consent;

  • To spam, phish, or scrape;

  • To interfere with security features of the Service or the internet.

We reserve the right to terminate your use of the Service for violating any prohibited uses.

15. Warranty & Product Guarantees

Our detailed Warranty Policy is incorporated by reference. In summary:

  • Many professional devices are covered by a 12-month Limited Warranty against defects in materials and workmanship under normal professional use.

  • Optional Extended Warranty may be available at checkout.

  • Normal wear and tear, consumable parts, misuse, improper storage, and unauthorized repairs are not covered.

15.1 Disclaimer of Implied Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVLO LASH CO. DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTY OF MERCHANTABILITY AND THE IMPLIED WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE.

If any implied warranties cannot be disclaimed, they are limited in duration to the term of the applicable Limited Warranty.

15.2 Exclusive Remedy

Your exclusive remedy for any defective product is repair, replacement, or store credit, at EvLo Lash Co.’s sole discretion.

16. Order Disputes & Chargebacks

By placing an order, you agree to work with us in good faith to resolve any issues consistent with our policies.

Filing a chargeback for matters covered by our Shipping Policy, Return Policy, or Warranty Policy (such as transit delays, customs fees, discount code errors, or buyer’s remorse) is considered a violation of these Terms. We reserve the right to:

  • Dispute such chargebacks with supporting documentation; and

  • Refuse future service to customers who engage in fraudulent or abusive disputes.

17. Disclaimer of Warranties

Except as expressly set forth in our written Warranty Policy, the Service and all products are provided “as is” and “as available,” without any warranties of any kind, express or implied.

We do not guarantee that the Service will be uninterrupted, timely, secure, or error-free, or that results obtained from the Service will be accurate or reliable.

18. Limitation of Liability

To the fullest extent permitted by law, EvLo Lash Co., its officers, directors, employees, agents, contractors, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost savings, data loss, or replacement costs arising out of or related to:

  • Your use of the Site or Service;

  • Your purchase or use of any product;

  • Professional use or misuse of lash products;

  • Shipping delays, lost or stolen packages, or customs actions.

In no event shall our total liability exceed the amount paid by you for the product or service giving rise to the claim.

19. Indemnification

You agree to indemnify, defend, and hold harmless EvLo Lash Co. and its affiliates, officers, directors, agents, contractors, suppliers, and employees from any claim or demand, including reasonable attorneys’ fees, arising out of:

  • Your breach of these Terms or related policies;

  • Your violation of any law or the rights of a third party;

  • Your misuse of professional products.

20. Severability

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be deemed severed. This will not affect the validity and enforceability of the remaining provisions.

21. Termination

These Terms are effective unless and until terminated by either you or us.

You may stop using the Service at any time. If in our judgment you fail to comply with any provision of these Terms, we may terminate or suspend your access to the Service without notice, and you will remain liable for all amounts due up to and including the date of termination.

22. Governing Law & Arbitration

These Terms and any separate agreements whereby we provide you products or services shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict-of-law provisions.

Any dispute or claim arising out of or related to these Terms, the Site, or any purchase shall be resolved through binding arbitration on an individual basis. Class actions and class arbitrations are expressly waived. Nothing in this section prevents either party from filing a claim in small-claims court where jurisdiction allows.

We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates to our website. Your continued use of the Site or Service after any changes are posted constitutes acceptance of those changes.

24. Mobile Terms of Service (SMS)

The EvLo Lash Co. mobile message service (the "Service") is operated by EvLo Lash Co. By consenting to our SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of EvLo Lash Co. to the mobile number you provided, including service-related and promotional messages. Message and data rates may apply. Message frequency varies.

You may opt out at any time by texting STOP as instructed in the message. For help, text HELP or email info@evlolash.com. Your participation is voluntary and is not a condition of any purchase.
